Application
These terms and conditions apply from 2022-01-31.

The following terms and conditions of purchase and delivery (”Terms of Purchase”) apply when you make a purchase in the 38 degree online store and related websites. When you make a purchase in the store, an agreement is entered into between you and Tells Färgvaruhus AB, corporate registration number: 556781-7563.

Ordering
You must be 18 years old to make a purchase with us. 

When you have completed your order, an order confirmation will be sent to your email address. In the confirmation you will find all information about products, price, payment and delivery address. If there is anything wrong with the order confirmation, please contact us immediately by email to order@38grader.com

Cancellation of an order can be made up until the product has been shipped. After that, you as the customer are responsible for the return shipping. We may refuse a purchase if you have provided incorrect information to us at checkout, if we suspect attempted fraud, or if the purchase cannot be completed because the product you have ordered is out of stock or unavailable. In such cases, we will notify you as soon as we can.

Delivery
Our normal delivery times for stock items are:
Accessories: 3-5 business days
Bathtub: 5-10 working days
Hot tub: 5-10 business days

If delays in delivery occur (without us notifying you of a longer delivery time), please contact us at order@38grader.com

Our products are only delivered to addresses in Sweden.

When delivering a hot tub, the following applies:
– The delivery address must be located along a road that is drivable next to the property boundary.
– Drivable means that the truck including trailer (up to 24 meters) can arrive and, if necessary, turn along the road.

Prices
All prices in the store are listed in SEK and include VAT and exclude shipping.

We reserve the right to adjust the price due to price changes from suppliers, possible typographical errors and changes in technical data that are beyond our control.

Promotions, discount codes and other offers
We may from time to time offer promotions, discount codes and other offers for various products. For products covered by such offers, the preferential price or the preferential terms apply during the limited period specified in connection with the current offer or while supplies last. Otherwise, these Terms of Purchase also apply to products covered by the offer.
Offers cannot be combined with other discounts unless otherwise expressly stated. Upon termination or revocation of the offer, these Terms of Purchase shall apply in their entirety to the products previously covered by the offer.

Right of withdrawal
When purchasing products from the website, you as a customer have a statutory 14-day right of withdrawal that applies from the time you have received a product that you have ordered.

When exercising the right of withdrawal
You must notify us of your withdrawal. The message should be sent to us at order@38grader.com. Your message should clearly state your name, address, email address, order number and which products you are returning.

You should return the products to us immediately and no later than within the statutory 14 days after exercising your right of withdrawal.

You are responsible for the delivery and return shipping of the products and are responsible for ensuring that they arrive in good condition. The products should therefore be sent well packaged and in their original packaging.

From the refund amount, we reserve the right to deduct an amount corresponding to the decrease in value compared to the original value of the product in the event of a used or damaged product. 

Complaints and claims
We inspect all products before they are shipped to you. Should the product still be damaged or incorrectly shipped when it arrives, we undertake, in accordance with applicable consumer protection legislation, to rectify the defect free of charge.

You must always contact us for approval before returning a defective item.

The complaint should be sent immediately after the defect is discovered.

How do you proceed in the event of a complaint?
Any product defects should be reported to our service form.

If we are unable to remedy the defect or deliver a similar product, we will refund you for the defective product in accordance with applicable consumer protection legislation. We will cover return shipping for approved complaints.

We reserve the right to refuse a complaint if it turns out that the product is not defective in accordance with applicable consumer protection legislation. When making complaints, we follow guidelines from the Swedish National Board of Complaints, see arn.se.

Limitation of liability
We take no responsibility for indirect damages that may arise due to the product.

We are not responsible for delays/errors due to circumstances beyond the company's control (Force Majeure). These circumstances may include, for example, labor disputes, fire, war, government decisions, reduced or non-existent delivery from the supplier.

Furthermore, no responsibility is taken for any changes to products/product characteristics that have been changed by the respective supplier and other factors beyond our control.

Product information
We reserve the right to any printing errors on this website and final sales of products. We do not guarantee that the images reflect the exact appearance of the products as a certain color difference may occur depending on the monitor, photo quality and resolution. We always try our best to expose the products as accurately as possible. 

Information about Cookies
According to the Electronic Information Act, visitors to a website must be informed, for privacy purposes, that cookies are used. The information in the cookie can be used to track a user's browsing. A cookie is a small text file that the website you are visiting requests to be saved on your computer to provide access to various functions. You can set your browser to automatically refuse cookies. 

Changes to the General Terms and Conditions
We reserve the right to make changes to the Terms and Conditions at any time. Changes to the Terms and Conditions will be posted online on the Website. The changed Terms and Conditions will be deemed accepted upon placing an order or visiting the Website.

Dispute and choice of law
In the event that a dispute cannot be resolved by mutual agreement between the company's customer service and the customer, you as a customer can turn to the Swedish General Complaints Board, see arn.se. For residents of an EU country other than Sweden, you can submit a complaint online via the EU Commission's platform for dispute mediation.

In the event of a dispute, we will follow decisions from ARN or a corresponding dispute resolution body.

Disputes regarding the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish law.

2. PAYMENT

We collaborate with Ecster, which offers payment solutions for both e-commerce and physical stores. Ecster is a wholly owned subsidiary of Handelsbanken.

Ecster Pay
In collaboration with Ecster, we offer invoice, installment payment, card payment and Swish through the e-commerce checkout Ecster Pay. 

By using the checkout you agree Ecster Pay's terms of use. By clicking "Complete purchase", you accept payment responsibility, terms and conditions for the selected payment method and agree to our terms and conditions of purchase.

All information in Ecster Pay is handled encrypted with SSL.

Partial payment
Sometimes it can feel good not to take the entire cost at once. With installment payments from Ecster, you always pay at a pace that suits you.

Invoice
In our store you have the option to choose an invoice and pay at home in peace and quiet.

Invoice terms
NOTE: In the link, the invoice fee is set to 0 SEK. If you wish to charge an invoice fee, replace the '0' at the end of the link with the fee you wish to charge.

Card payment
We offer card payments with Visa, Mastercard and Maestro. There is no fee for card payments.

Swish
If you are connected to Swish, you can pay via your Swish app. Open the app on your mobile device and approve the payment with your Mobile BankID.

After the purchase is completed, the money is withdrawn directly from your bank account. In the event of a return, the money is refunded to the same account.
